These Terms of Service ("Terms") govern your access to and use of the Actify mobile applications for iOS and Android and the website at actifyfitness.com (collectively, the "Service"), operated by Actify Fitness ("we," "us," or "our"). The Service helps you train and eat with structure: personalized plans, daily scoring, streaks, XP, and progress views—aligned with our product vision of making consistent health habits rewarding without losing seriousness about your data.
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or 16 in the EEA where applicable) to use the Service. You represent that you meet this requirement and have authority to agree to these Terms.
2. Accounts
- Provide accurate information when you register.
- Keep your credentials secure. You are responsible for activity under your account.
- Notify us if you suspect unauthorized access at support@actify.fit.
- We may suspend or terminate accounts that violate these Terms or harm the Service or other users.
3. What the Service Provides
Actify includes, among other features:
- Personalized workout and nutrition planning based on the profile and preferences you provide, produced by our backend planning systems from curated exercise and meal content
- Logging for workouts, meals, water, weight, and related metrics you choose to record
- A daily score (up to 10 points) combining workout, nutrition, water, sleep, and steps dimensions; streaks and XP as described in-app
- Optional integration with Apple Health (iOS) and Health Connect (supported Android devices), subject to your permissions
- Premium features such as expanded plan refresh and, where offered, AI-assisted meal photo recognition to speed up logging
Features may evolve. We do not guarantee uninterrupted or error-free operation.
4. Health Disclaimer
The Service is for fitness and wellness support only. It is not medical advice, diagnosis, or treatment.
- Plans and scores are computed from information you supply and general fitness principles. They are not individually reviewed by a clinician.
- Consult a qualified professional before starting or changing exercise or diet, especially if you have medical conditions.
- Stop activity and seek help if you experience pain, dizziness, chest discomfort, or other concerning symptoms.
- To the fullest extent permitted by law, we are not liable for injury or health outcomes from your use of the Service.
5. Subscriptions & Billing
5.1 Free tier
Core functionality is available without charge. Specific limits (e.g. plan regeneration, history, or recognition features) are shown in-app.
5.2 Premium
- Paid subscriptions are offered where enabled, typically monthly or annual.
- Purchases are processed by Apple App Store or Google Play. Their payment terms apply.
- Subscriptions renew automatically unless you cancel before the renewal date in your store account settings.
5.3 Refunds
Refunds follow Apple's or Google's policies. We do not independently process app-store payments.
6. Acceptable Use
You agree not to:
- Use the Service unlawfully or to harm others
- Misrepresent your identity or manipulate scores or data dishonestly
- Attempt unauthorized access to accounts, systems, or data; scrape or overload the Service; or reverse engineer except where law permits
- Upload unlawful, infringing, or abusive content
7. Intellectual Property
- The Service—including software, design, branding, and curated content—is owned by Actify Fitness or its licensors and protected by applicable laws.
- You keep ownership of information you submit (e.g. logs). You grant us a license to use it to run and improve the Service.
- Do not copy, modify, or redistribute the Service except as allowed by law or with our written consent.
8. Third-Party Services
Apple, Google, Firebase, RevenueCat, and other integrations are subject to their own terms. We are not responsible for third-party services you choose to use alongside Actify.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the Service.
- Our total liability for claims relating to these Terms or the Service is limited to the greater of (a) the amount you paid us for Premium in the twelve months before the claim or (b) fifty U.S. dollars (USD $50), except where law forbids such a cap.
10. Indemnity
You agree to indemnify and hold harmless Actify Fitness and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or breach of these Terms, to the extent permitted by law.
11. Termination
- You may delete your account as described on our Data Deletion page.
- We may suspend or terminate access for violations or operational reasons.
- Sections that should survive (e.g. liability, indemnity, intellectual property) survive termination.
12. Changes to These Terms
We may update these Terms. We will post the revised version and update the "Last updated" date. Continued use after changes means you accept the updated Terms where allowed by law.
13. Governing Law & Disputes
These Terms are governed by the laws of India, without regard to conflict of law rules. Disputes should first be addressed with us at support@actify.fit. If not resolved, disputes are subject to the exclusive jurisdiction of the courts in Bengaluru, India, unless applicable law requires otherwise.
14. Severability
If any provision is held invalid, the remainder remains in effect to the fullest extent permitted.
